About Council


 

According to Regulation on the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone of Shenzhen Special Economic Zone andProvisions on the Administration of Shenzhen Court of International Arbitration (for Trial Implementation), SCIA is the nationally first Arbitration Institution established by legislation with its legal person governance model. It adopts the advanced international commercial arbitration systems and implements the Council-centered management model with effective check-and-balance in Decision-making, implementation and supervision, to ensure the independence of the arbitration institution and arbitral tribunal.   

 
Currently, the Council of SCIA is composed of eleven members who are mainly representative individuals in legal profession and in industry. Among the eleven, seven of them are mainland members including Mr. Zheng Hongjie, General Director of Authority of Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone of Shenzhen, and four are overseas members including Mr. Anthony Neoh, Senior Counsel and the former Chairman of the Hong Kong Securities and Futures Commission. Nine of them are external commissioners. The Council set up three special committees including the Rules Making Committee, the Arbitrator Qualification and Discipline Supervision Committee, and the Remuneration Committee. In accordance with Provisions on the Administration of Shenzhen Court of International Arbitration (for Trial Implementation) and Articles of Association of Shenzhen Court of International Arbitration, the Council performs the following functions:
 
 (1) To draft and amend the Statute, arbitration rules, mediation rules, and other dispute resolution rules;
 (2) To nominate the candidates of Secretary General and Deputy Secretary General;
 (3) To review the establishment, modification and dismissal of special/professional committees, and making decisions on the staff employment for the pecial/professional committees;
 (4) To make the panel of arbitrators, decide appointment and non-appointment of the arbitrators, experts specialized in other alternative dispute resolutions;
 (5) To decide the establishment and dismissal of subsidiaries, according to the proposal of Secretary General;
 (6) To censor the annual work report and reports of financial budget and statement;
 (7) To review the plans for establishment and modification of internal bodies as well as staff scale;
 (8) To draft and amend important internal regulations including, but not limited to, arbitrators remuneration rules, staff employment and remuneration rules; and
 (9) Other functions stipulated in the Articles of Association.
